Terms and Conditions

In reference to the law of July 13, 1992 (decrees published in the Official Journal on June 14, 1994) governing the sale of travel services.

Registration for one of our stays implies acceptance of our general and specific terms and conditions. It will be considered under the terms described in the general and specific terms and conditions of sale.

To register, simply complete the attached registration form and return it to us, signed and accompanied by the required deposit. Your registration will be confirmed upon receipt of the deposit.

You must pay a deposit of 30% of the total tour price.

30 days before departure, the remaining balance must be paid in full without any reminder from us.

Please include full payment for the tour.

We reserve the right to refuse registrations once the maximum number of participants has been reached.

Prices are in euros, including all taxes (TTC). They apply from the meeting point to the dispersal location.

They include the services specified in the description of your tour.

In general, prices do not include (unless otherwise stated in your technical sheet):

- Airfare and train tickets

- Cancellation and repatriation insurance

- Airport taxes

- Personal expenses

- Beverages

- Wine during meals

- Any service not mentioned in the tour’s technical sheet

Any cancellation before departure must be sent to us by registered letter with acknowledgment of receipt.

The amount retained will be calculated according to the following scale:

- More than 30 days before departure: Fixed fee of €50 per person to cover administrative costs

- Between 30 and 15 days before departure: 50% of the total stay price

- Between 14 and 8 days before departure: 75% of the total stay price

- Less than 8 days before departure: No refund

A non-refundable fixed fee of €50 per person, covering administrative costs, will be charged regardless of the cancellation date. This fee is separate from any other costs that may be reimbursed by your insurance in the event of a justified cancellation, provided you have purchased such insurance. The insurance only takes effect 30 days before departure. Therefore, administrative fees, as well as the insurance cost itself, are non-refundable by the insurance.In case of cancellation for a valid reason and for the reimbursement of your air or land transport costs, please contact your insurance provider.

If you fail to show up at the meeting point or decide to terminate your stay for any reason during its course, you will not be entitled to any refund or compensation from Nature Occitane. If you arrive at the meeting point after the scheduled time, any transportation required to reach the tour location will be at your own expense, with no compensation from Nature Occitane.

In the event of an accident or illness during your stay that requires its interruption, your personal insurance will cover the costs and may reimburse you after evaluation. You will not be entitled to any refund or compensation from us.Similarly, the guide or accompanying staff reserves the right to end the stay of any participant who does not meet the required level of fitness or whose essential equipment does not meet the specifications provided in the tour description sent to them, with no refund from us.Failure to adhere to safety instructions may result in the exclusion of participants, with no compensation from Nature Occitane.

A modification of the trip refers to any change made after your registration, such as changes in the number of people, reserved services, etc. A modification is not considered a cancellation.The client can request one or more modifications. Each modification requires administrative and/or reservation interventions by Nature Occitane. In return, Nature Occitane charges a fee of €35.00 including tax for each modification and for each person involved.Furthermore, the client is informed that any modification may result in additional costs (per modification and per person) charged by the service providers used by Nature Occitane.

The guided tours we offer are subject to a minimum number of participants. We may be required to cancel certain departures due to insufficient participants. You will be notified no later than 21 days before the departure date. A replacement option will be offered to you. If the replacement option does not suit you, we will refund the full amount paid, with no entitlement to compensation.In case of final cancellation, we will refund the full amount paid, with no entitlement to compensation from Nature Occitane.

In accordance with the legislation, Nature Occitane holds professional liability insurance. Each participant must also have individual liability insurance.To protect you in case of incidents or accidents during your stay, it is essential to have a comprehensive insurance policy covering cancellation, assistance, and repatriation costs.

We offer the "Contrat Open Evasion" insurance from Europ Assistance – a specific contract with the National Union of Mountain Guides. This insurance is tailored to the type of trips we organize.This insurance is optional and must be taken out, if desired, at the time of registration. The cost of the insurance is 6% of the trip price.IMPORTANT: OUR NEW CONTRACT ALSO COVERS COVID-19.

Given the unique nature of our trips and stays, we cannot be held responsible or liable for any compensation in case of changes to dates, schedules, or itineraries, especially if these modifications are due to unforeseen events, weather conditions, or imperative circumstances affecting the safety of the travelers.Each participant must follow the advice and instructions given by the guide or group leader. We cannot be held responsible for incidents, accidents, or bodily harm resulting from reckless personal decisions.

Acting as an intermediary between the client and the service providers (transporters, hoteliers, charter companies, local agencies, etc.), we are not to be confused with these service providers, who retain their own responsibility at all times.If the outbound and return dates of your trip are modified due to disruptions in air transport, we cannot be held responsible and will ask you to contribute to the actual additional costs incurred.If we are unable to provide part of the services initially agreed upon, we will do our best to replace them with equivalent services.When circumstances require, we may be forced to substitute one mode of transportation for another, change accommodation, take a different route, or cancel certain excursions. These exceptional changes will not entitle you to any compensation. The buyer cannot refuse these modifications without valid reasons.

The rented equipment is the property of Nature Occitane. As such, it cannot be seized by third parties. The renter is not entitled to transfer ownership of the equipment. It cannot be sublet to a third party without the lessor’s consent. The renter must not make any superficial or substantial modifications to the equipment.

The renter acknowledges that the rented equipment is in good working order and complies with current regulations at the time of rental. The renter agrees to use the equipment with care, not exceeding its limits.In the event of a technical failure of the rented equipment, the renter may only undertake repairs with the prior approval of Nature Occitane. Under no circumstances can the renter claim damages or compensation.The renter declares that the users of the equipment are fit to ride a bike and have no medical contraindications. The renter ensures that the users will respect the Highway Code. If they violate any laws or regulations, Nature Occitane cannot be held responsible.The rental transfers the legal custody of the equipment to the renter. The renter releases Nature Occitane from all liability arising from the use of the rented equipment and any suggested routes, especially regarding accidents or damage caused to third parties.The renter assumes full responsibility for the equipment from the moment it is picked up at our premises until its return. The renter is solely responsible for any damage caused to the equipment or by the equipment. In the event of an incident, the equipment will be charged at the price of new equipment, according to the current rate, plus repair costs at the prevailing rates.

The renter is responsible for all risks related to their civil liability, in the event of any damage caused by the equipment or any usage while it is in their custody. The renter may insure the equipment for its replacement value as new. The insurance must cover the risks of theft, loss, or damage, regardless of the cause or nature.

In the event of theft of the rented equipment or part of it, the renter must provide proof of a police report filed with the local police station within a maximum of 48 hours after the incident. Nature Occitane will be forced to charge for the unreturned equipment at the current price of new equipment, according to the rate in effect (see "Responsibility" paragraph).

Any cancellation on your part before departure must be sent to us by email or registered letter with acknowledgment of receipt.

The amount of retained sums will be calculated according to the following scale:

- More than 30 days before departure: Fixed fee of €50 per bike to cover administrative costs

- Between 30 and 15 days before departure: Retention of 50% of the rental price

- Between 14 and 8 days before departure: Retention of 75% of the rental price

- Less than 8 days before departure: No refund

Nature Occitane provides insurance for:

- €2 per day per bike and/or equipment

- €3 per day per electric bike

Any dispute arising from the general terms and conditions of sale is subject to the jurisdiction of the commercial court in Perpignan (66).
